Terms and Conditions

These Terms & Conditions apply to the website, tutoring programs and related services provided by Orin Education Pty Ltd (“Orin Education”, “Orin”, “we”, “us” or “our”).

By using our website, submitting an enrolment or purchasing an Orin service, you agree to these Terms & Conditions.

1. Parent and Guardian Authority

Where a student is under 18, the enrolment must be completed or authorised by a parent or legal guardian.

The parent or guardian is responsible for:

  • providing accurate and current information;

  • notifying Orin of relevant medical, learning or safety requirements;

  • paying applicable fees; and

  • ensuring the student complies with these Terms & Conditions.

2. Enrolment

Submitting an enquiry or enrolment form does not guarantee a place.

An enrolment is confirmed when Orin accepts the enrolment and any required payment has been received.

Unless otherwise stated, enrolment is for the relevant school term or program shown in the enrolment information.

Students joining after a term has commenced may be charged only for the remaining classes, unless a different arrangement is disclosed before enrolment.

3. Fees and Payment

Course fees and payment dates will be stated on the enrolment form, invoice or course information.

Fees must be paid by the due date. Orin may suspend class attendance, access to recordings or learning materials where an account remains overdue after reasonable notice.

Any card or payment processing surcharge will be disclosed before payment and will not exceed the applicable cost permitted by law.

Orin may change fees for future terms or programs by giving reasonable notice. A fee change will not apply retrospectively to services already paid for.

4. Withdrawal, Cancellation and Refunds

Unless otherwise stated, enrolment is for the full term or program, or full year.

Fees are generally not reduced or refunded because of:

  • student absence;

  • change of mind;

  • family holidays;

  • changes to school or personal schedules; or

  • failure to complete homework or use provided materials.

Requests to withdraw due to serious illness, relocation or other exceptional circumstances may be considered reasonably on a case-by-case basis.

Where Orin cancels a class, we may provide a replacement class, make-up class, credit or refund for the affected service.

Nothing in these Terms excludes any right or remedy available under the Australian Consumer Law.

5. Attendance and Make-Up Classes

Students should attend classes punctually and regularly.

Parents or guardians should notify Orin as early as possible if a student will be absent.

Where an equivalent class is available, Orin may allow the student to attend a make-up class. Make-up classes:

  • require prior approval;

  • are subject to class capacity and tutor availability;

  • may be offered at another time or location; and

  • are not guaranteed.

An unused make-up class does not create an automatic entitlement to a refund or credit.

6. Course and Timetable Changes

Orin may reasonably change a tutor, classroom, course location, timetable or delivery method where necessary because of staffing, venue availability, student numbers, safety concerns or circumstances outside our reasonable control.

We will provide reasonable notice where practicable and will seek to provide a substantially equivalent service.

If Orin cannot provide the relevant service or a reasonable alternative, an appropriate credit or refund will be provided for the affected portion.

7. Student Conduct and Safety

Students must:

  • behave respectfully towards other students, tutors and staff;

  • follow reasonable classroom and safety instructions;

  • avoid bullying, harassment, discrimination or disruptive behaviour;

  • use Orin facilities, technology and learning platforms appropriately; and

  • respect the privacy and property of others.

Orin may remove, suspend or terminate a student’s enrolment where serious or repeated behaviour creates a safety risk or materially disrupts the learning of others.

Where practicable, Orin will discuss concerns with the parent or guardian before terminating an enrolment. Any refund or credit will be considered reasonably, having regard to the circumstances and applicable law.

8. Educational Results

Orin will provide its services with reasonable care and skill.

However, academic progress depends on factors including attendance, effort, prior knowledge, homework completion and school participation.

Orin does not guarantee any particular grade, examination result, scholarship, selective-school placement or other academic outcome.

9. Learning Materials and Intellectual Property

All Orin workbooks, assessments, lesson plans, recordings, videos, online resources, teaching methods and other course materials remain the intellectual property of Orin or its licensors.

Materials are provided only for the personal educational use of the enrolled student.

Without Orin’s written permission, you must not:

  • copy, sell, publish or commercially use Orin materials;

  • share materials or recordings with students who are not enrolled;

  • upload materials to websites, social media or file-sharing platforms;

  • record classes; or

  • use Orin materials to provide another tutoring service.

Serious misuse may result in suspension or termination of access.

10. Photographs and Class Recordings

Orin may record classes for revision, quality assurance, tutor training, safety or incident review where appropriate notice has been provided.

Students and parents must not record, photograph or publish a class or another person without permission.

Student photographs, videos, testimonials or academic results will not be used for public marketing without appropriate consent.

11. Website Use

Website content is provided for general information and may change from time to time.

Although Orin takes reasonable steps to keep information accurate, course availability, fees, locations and timetables remain subject to confirmation.

You must not:

  • misuse or interfere with the website;

  • attempt to access systems or information without authorisation;

  • introduce malicious software;

  • copy website content for commercial use; or

  • use the website for unlawful, misleading or fraudulent purposes.

Links to third-party websites are provided for convenience. Orin does not control and is not responsible for the independent content or practices of those websites.

12. Liability and Consumer Rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee or other right that cannot legally be excluded under the Australian Consumer Law.

To the extent permitted by law, Orin is not responsible for indirect or consequential loss that was not reasonably foreseeable or caused by matters outside Orin’s reasonable control.

13. Privacy

Personal information is handled in accordance with Orin’s Privacy Policy and applicable Australian privacy laws.

14. Changes to These Terms

Orin may update these Terms for future website use, enrolments or school terms.

Material changes affecting an existing enrolment will be communicated where reasonably necessary and will not remove rights already accrued under applicable law.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia.
